Senator Ted Cruz (R-TX) said this week that former President Trump would be the target of a politically motivated federal prosecution.
Cruz made the prediction based on his claim that Attorney General Merrick Garland has a personal grudge against Republicans and Trump, in part because they turned him down for a Supreme Court nomination in the past.
During an interview with Fox News commentator Sean Hannity, Cruz said, “Mark my words: I think Merrick Garland will indict Donald Trump. He despises Donald Trump and wants to bring charges against him. He despises him. He’s furious. The fact that Merrick Garland was not confirmed to the Supreme Court has angered him.”
This week, Trump’s legal team paid a visit to the DOJ as special counsel Jack Smith allegedly gets closer to deciding whether to file charges against the president for storing secret documents and obstructing justice by thwarting attempts by the agency to recover them. Trump maintains his innocence by asserting that he had the authority to collect the declassified materials before leaving office and did so.
Cruz said that since investigators discovered other high officials, including President Biden along with former Vice President Mike Pence, had inappropriately kept confidential information in their hands after leaving office, Garland’s DOJ would concentrate on pursuing fabricated obstruction allegations.
Cruz said: “Keep in mind, that he is not claiming the underlying classified documents were illegal because he’d also have to indict Joe Biden. He’ll invent a crime around a non-crime instead. That will serve as the indictment’s foundation.”
Cruz has established himself as a prominent Trump loyalist after their spat during the 2016 GOP presidential primary race. Trump is now engaged in a second presidential campaign.
Cruz, a senator who sits on the Senate Judiciary Committee, which has oversight authority over the DOJ, said that Garland had “corrupted” both the DOJ and its law enforcement division, the FBI. He predicted that the DOJ would try to portray a false sense of impartiality by also charging Biden’s adult son, Hunter, in order to gain political advantage while disregarding real claims of corruption involving the president and his family.

Cruz predicted of Garland, “He will do it on entirely personal matters, dealing with firearms, drugs, and tax-related problems for Hunter that have nothing whatsoever to do with Joe Biden since the DOJ wants to safeguard and shield Joe Biden and the corrupt practices of the Biden family, although they want to use Hunter Biden to serve as a scapegoat in order to justify targeting President Trump.”
