A federal judge ruled against the Trump administration’s Title 42 policy, and Border Patrol agents have reportedly stated that they expect a major influx of new migrants at the border.
Title 42 was also known as the “stay in Mexico” policy since the emergency pandemic solution required asylum seekers to wait in Mexico for their papers to be processed. Prior to the judgment, they would be permitted to enter the United States and await a decision from officials on the validity of their asylum applications.
The Title 42 ruling is “arbitrary and capricious in violation of the Administrative Procedure Act,” wrote District Judge Emmet Sullivan in Washington, D.C., on Tuesday.
Critics of the strategy have termed it barbaric and in violation of previous US worldwide humanitarian commitments.
Sullivan chastised the Centers for Disease Control and Prevention for not permitting alternate methods of preventing the spread of the coronavirus pandemic, which was the premise underlying the Title 42 policy.
“With regard over whether defendants might have accelerated vaccines, outside processing, and any other available public health procedures,” Sullivan said, “the judge ruled that the CDC failed to offer a satisfactory reason for why such steps were not possible.”
Democrats, naturally, welcomed the decision, despite the likely negative impact on border security.
“Asylum is a human right,” Rep. Chuy Garcia tweeted.
“Title 42 was a terrible, barbaric policy,” he went on to say. “As I celebrate this decision, I recall the upwards of two million migrants that have been refused entry at the border as a result of this policy.”
“A federal judge overturned Title 42, the program that permitted border authorities to promptly deport many migrants regardless of their asylum claims. This is a significant step in the right manner,” The National Immigration Forum, a migrant rights group, tweeted its official account.
“A HUGE WIN OVER TITLE 42! The Biden admin. will now have to let asylum seekers into the country!” United We Dream was tweeted.
Many on the left chastised the Biden administration for utilizing Title 42 to keep many Venezuelan asylum seekers out of the country while their claims were reviewed.
